www.greyhoundauctions.au (the Site) is operated by Neil Brockington & George Lucas for Greyhound Auctions Australia (ABN 33261780897) 30 Anna Street Beaudesert Qld 4285 – Chattel Auctioneers Act 2014 License Number 4573216.
- By signing up as a new member of greyhoundauctions.au, you are agreeing to be bound by the following terms and conditions. If you do not accept the terms and conditions you must refrain from using this Site. Greyhound Auctions Australia / greyhoundauctions.au reserve the right to cancel your membership or bid at any time it feels its members are in breach of any special conditions. By signing up to the site, you agree to be added to our database. You can opt out anytime by unsubscribing at the bottom of the email newsletter.
- The buyer and seller acknowledge under no circumstance will they ever bid to “run up” the price of any lot for sale, at any stage of the sale process. The vendor is allowed to buy back their *lot & can therefore place a “vendor bid” at any stage of the sale. *lot being, race dog, unraced break-in, pup(s) or straw(s).
- Greyhound Auctions Australia (ABN 33261780897) / greyhoundauctions.au offers the details of this greyhound in good faith but cannot guarantee or warrant the accuracy of this information nor warrant the condition of the greyhound. We are acting as agent for the buyer and seller.
3.1 We expect that all greyhounds being auctioned are in sound condition and if they have any injuries that may impact their performance then the Seller must disclose. We offer the ability for sellers to upload any vet reports in PDF format when listing dogs for auction.
3.2 If at some time it is proved that the Seller has not disclosed information that should have been reasonably disclosed we will not accept future lots from that Seller. The buyer acknowledges Greyhound Auctions Australia (ABN 33261780897) / greyhoundauctions.au take no responsibility for the seller’s actions, including and not limited to, lack of full disclosure or dishonest conduct.
3.3 Greyhounds are offered subject to price change, or withdrawal from the market “anytime” without notice, including any sale/agreement, whereby the reserve price has been met. In the instance of the reserve price being met and the seller withdrawing the lot from greyhoundauctions.au website, Greyhound Auctions Australia can seek full commission off the seller.
3.4 Photos may not properly reflect the current condition of the actual greyhound offered for sale
- The purchaser accepts that once payment is made after the sale, we (Greyhound Auctions Australia / greyhoundauctions.au) will chase up transfer of ownership forms and will endeavour to obtain them for you as quickly as possible. We do encourage that you email us after purchase, confirming the preferred postal address and or emal address for transfers.
- Papers and Payment
5.1 You accept that the delivery of papers / dog ID is the sole responsibility of the seller to the purchaser, (you). This includes any lost paperwork or failure of the seller to complete them in a timely manner. Any replacement cards if required are at the expense of the greyhound trainer / seller or buyer.
5.2 Seller will receive net payment / proceeds of sale once Greyhound Auctions Australia is in receipt of the postage transaction / tracking number and acknowledge that the greyhound can be picked up as soon as Greyhound Auctions Australia has been paid in full by the purchaser after the auction / private sale has been completed. Once the seller has provided Greyhound Auctions Australia proof of all relevant documentation being delivered / posed to purchaser and or ID key if transfer is done online. Greyhound Auctions Australia will make every effort to pay the seller all “net proceeds of sale” within 72 hours. “Net proceeds of sale” meaning sales price, less all associated fees, including commission and GST. The seller accepts that the greyhound can go immediately after full payment is received by Greyhound Auctions Australia (ABN 33261780897) / greyhoundauctions.au.
5.3 There may be G.S.T on purchase if sellers are registered, ranging from 0-10% of purchase price, calculated at checkout stage. It won’t be visible on the website or listing and is calculated & added at payment stage on the invoice, before payment is made. Whilst every endeavour is made by us to encourage sellers to disclose applicable G.S.T in their listings, sellers & Greyhound Auctions Australia cannot be held liable if G.S.T is applicable & isn’t listed on the site. Buyer’s will have to pay the sale price, plus any applicable G.S.T for the sale to be binding between the buyer, the seller & Greyhound Auctions Australia (ABN 33261780897) / greyhoundauctions.au.
- Greyhound Auctions Australia / greyhoundauctions.au is a business and marketing service whereby we market greyhounds on behalf of owners and trainers / breeders, to the general public. Whilst we make every endeavour to disclose all information on the listing / greyhound for sale, we will not be held liable or responsible in any way after you are the successful bidder / buyer of an auction or privately brokered sale post or pre auction. You are not entitled, under any circumstances, for compensation for any faults, imperfections or other defects arising in the Lot(s) before or after sale, whether clearly visible or not. The purchaser acknowledges that, in making any purchase, reliance is solely on that persons own enquiries and inspection, and that the person has not relied or been induced by any statement or representation made by the vendor / seller or Greyhound Auctions Australia (ABN 33261780897) / greyhoundauctions.au or by any person purporting to act on their behalf and, subject to these Terms and Conditions, the purchaser shall take the greyhound in its present condition and subject to all defects, faults, imperfections and the like, if any, whether latent or patent; and/or
- You acknowledge having had every opportunity to contact the relevant parties associated with the greyhound for sale / auction and also accept you had every chance to obtain a vet certificate or inspection of the greyhound. We strongly recommend that you obtain your own independent inspection by a qualified and independent vet, however, you bid acknowledging that Greyhound Auctions Australia (ABN 33261780897) / greyhoundauctions.au did not stop you at any stage from doing this, or influence your decision to bid on any listing greyhoundauctions.au. We cannot be held liable for a greyhound’s soundness in any way. Any purchaser assumes all consequences and risk arising from failure to carry out an inspection of a Greyhound.
7.1 If you choose to share your log in details with anyone else and they are the successful bidder, please be mindful that you’re liable to complete the transaction as per all terms and conditions of sale here still.
- By joining the site, you agree that under no circumstance will you attempt to negotiate the purchase of any greyhound directly off the owner, trainer or breeder. You’ll be liable for all commission and associated costs of sale should you be found guilty of this, if a sale is negotiated behind Greyhound Auctions Australia (ABN 33261780897) / greyhoundauctions.au back. “The sale” refers to any listing on Greyhound Auctions Australia (ABN 33261780897) / greyhoundauctions.au website.
- Owners / trainers / breeders can charge their spelling, handling or kennelling rates 5 days after payment or expiration of the auction (or private sale) whichever comes 1st, should they decide to do so. This is at their discretion should they see fit to do so. The seller acknowledges that this is between the seller and buyer and in no way associated withGreyhound Auctions Australia (ABN 33261780897) / greyhoundauctions.au. We encourage booking transport immediately after sale, so that pick up is swift. Allowing for clear full payment before pick up. No greyhound under any circumstance can go before the Greyhound Auctions Australia – grehoundauctions.au has clear funds / or the agent acknowledges being in receipt of an official bank “remittance” notice / received by email or picture text. This amount being no less than the full amount of the sale price (final end-of-auction- reserve met bid)
- Greyhound Auctions Australia (ABN 33261780897) / greyhoundauctions.au and the owners of any sold lot on greyhoundauctions.au take no responsibility for the greyhound once payment is made and or the greyhound is collected. The purchaser is encouraged, at their expense, to insure the greyhound in transit or at the point of sale. We are not liable in any way financially, for any greyhound, sold or marketed by Greyhound Auctions Australia (ABN 33261780897) / greyhoundauctions.au website. Also, once the greyhound enters the dog float for transport, the new purchaser is also 100% liable for the greyhound. Any issues arising are between the float / transport company (or individual) and purchaser, or between the owner and seller directly and has nothing to do with Greyhound Auctions Australia (ABN 33261780897) / greyhoundauctions.au.
- You acknowledge “if” under any circumstance you’re not happy with your purchase, the maximum you can seek does not include Greyhound Auctions Australia (ABN 33261780897) / greyhoundauctions.au fees associated with the sale.
- G.S.T if applicable is never more than 10% of the sale / purchase price. In some instances the G.S.T isn’t fully known at the time of sale,Greyhound Auctions Australia (ABN 33261780897) / greyhoundauctions.au can claim up 10% of the G.S.T on behalf of the sellers, as long as the purchaser is notified before the sale expiration or after the sale expiration, before settlement. In some rare circumstances where the seller may be unaware or discover the exact amount of G.S.T and it is after settlement, you accept that you still have to pay this in order to complete the sale and take possession of all signed paperwork, being the transfer of ownership document.
- The increments by which bids will increase are up to $100.
13.1 You will be able to bid on advertised Lot(s) until the second prior to the advertised closing date and time of the auction. You understand and accept that any bids placed in the last 60 seconds, re-sets the clock back to a 30 second countdown until all bidding ceases. This is to enable all parties every opportunity to compete fairly and make an informed & rational decision. We are not responsible for last minute / second bids that may not register due to issues such as poor network connection, low Wi-Fi signal, wrong bid amount etc.
13.2 The vendor or any syndicate member can bid on their greyhound or straw(s) anytime, whether listed for reserved or unreserved sale. They are bound by all the same special conditions as everyone else and accept that all commission and fees are payable to Greyhound Auctions Australia (ABN 33261780897) / greyhoundauctions.au should they be the successful bidder / purchaser. The rate being $100 (+GST) marketing and admin fee (if advertised special is running $50 (+GST), 5% commission (plus G.S.T) (minimum commission of $250 +GST applies) whichever is greater – on all new listings as of 1/09/23 onwards.
14. If there’s a bidding dispute we shall act to resolve it fairly. As their can only be one buyer for any greyhound, our decision is final and you must accept this and place no blame or liability on Greyhound Auctions Australia (ABN 33261780897) / greyhoundauctions.au.
14.1 Users place anonymous bids, with personal details hidden until the auction ends. Latest bid amount is displayed, but bidder’s identity remains anonymous. You will receive an email notification when you have been out-bid, however we are not liable in any way for issues that can arise anytime, preventing you from receiving this communication / out-bid notification from Greyhound Auctions Australia (ABN 33261780897) / greyhoundauctions.au.
15. Greyhound Auctions Australia (ABN 33261780897) / greyhoundauctions.au reserves the right to cancel or withdraw bids at its discretion, as well as change the auction finish time, reserve or date. There are unforeseen circumstances which may warrant this, such as website technical difficulties etc, which can arise anytime. If we suspect a bidder is manipulating an auction, we will withdraw their bid immediately and inform them that they have been banned, unless they can explain and prove otherwise.
16. The successful bidder, being the purchaser, if he or she fails to respond to communication regarding settlement / payment in full, within 12 hours of the auction expiration or 12 hours from point of communication from Greyhound Auctions Australia (ABN 33261780897) / greyhoundauctions.au, acknowledges that they will take no further action against Greyhound Auctions Australia (ABN 33261780897) / greyhoundauctions.au for re offering the greyhound / straw(s) to under-bidders or the market-place in general, with the intent being to sell the greyhound / or straw(s). This attempted communication can be either by phone, text or email – a copy of either method as proof of contact will be provided if there’s any discrepancy. The greyhound can then be sold to any other party Greyhound Auctions Australia (ABN 33261780897) / greyhoundauctions.au, engages into an agreement with.
17. Listing payments by Stripe will incur a 2% surcharge, payable by the buyer / seller. Purchasers will also have the option of settling their greyhound auction or private sale “purchase”, by electronic funds transfer (no fee for E.F.T).
